However, the evidence did not establish that the accused was in possession of a deadly weapon at or immediately before or after the robbery, as the brandishing of the panga occurred several hours after the theft. The court held that the prosecution failed to prove the element of aggravated robbery but did prove simple robbery under section 285 of the Penal Code Act. The accused was therefore acquitted of aggravated robbery and convicted of simple robbery.
