[2003] UGHCCRD 3

The prosecution proved the occurrence of death, its unlawfulness, and malice aforethought beyond reasonable doubt. However, the evidence connecting the accused to the crime relied solely on identification by PW1 and PW2 under unfavourable conditions, with inconsistencies and lack of corroboration. The defence of alibi was not disproved by the prosecution, and doubts remained as to whether the accused were present at the scene.
