The trial magistrate erred by acquitting the respondent on a defective charge of theft of maize, despite clear evidence that the respondent received Shs.12,000,000/= from PW1 for the purchase of maize, which he failed to deliver. The prosecution did not prove the existence or quantity of maize, nor that it became PW1's property, thus failing to establish theft. However, the evidence proved the offence of obtaining money by false pretense under section 305 of the Penal Code Act. The trial court should have amended the charge to reflect the actual offence disclosed by the evidence, as permitted by section 132(1)(a) of the Magistrates Courts Act.
