The prosecution proved beyond reasonable doubt that the deceased died, the killing was unlawful, and the accused participated in the killing. However, the prosecution failed to prove malice aforethought, as there was no evidence that the accused intended to kill or aimed at the deceased. The accused's version of accidental discharge was not negatived by prosecution evidence. Consequently, the accused was acquitted of murder but convicted of manslaughter. In sentencing, the court considered the accused's status as a first offender, his remorse, and the lengthy remand period, and sentenced him to a term equal to time already served on remand.
