The continued remand of the accused without prospects of trial was deemed to violate his constitutional right to a fair and expeditious trial. The court held that unexplained absence of witnesses does not justify indefinite adjournment and that the interests of justice require dismissal of the case for want of prosecution. The court invoked section 17(2) of The Judicature Act to dismiss the case and ordered the immediate discharge of the accused.
