The indictment was incurably defective as it charged the accused with rape under Sections 123 and 124 of the Penal Code Act, whereas the evidence established that the victim was 13 years old, making defilement under Section 129 the applicable offence. The prosecution failed to amend the indictment despite being given an opportunity. The High Court has no power to amend an indictment to charge an offence not disclosed by the summary of evidence. As a result, the accused was tried on a charge that could not stand in law, and the evidence adduced was null and void. Continuing the proceedings would amount to a miscarriage of justice.
