Ratio Decidendi

The court found that the prosecution had proved the death of the deceased, that the death was unlawfully caused, and that it was caused with malice aforethought. However, the evidence did not establish the participation of A1 and A3 in the murder. Both prosecution witnesses confirmed that A1 and A3 were away fishing at the material time and that A2, Uyeregiu, was solely responsible for the murder. There was no evidence of common intention between A1, A3, and A2. The plea of guilty by A2 further exonerated A1 and A3. Consequently, the court held that no prima facie case had been made out against A1 and A3, and acquitted them under section 73(1) of the Trial on Indictments Act.
