Procedural Posture

Criminal Law / Sentencing

  1. 1 Whether the accused is guilty of murder and aggravated robbery on his own plea of guilty.
  2. 2 What is the appropriate sentence for the offences committed by the accused.

Ratio Decidendi

The accused pleaded guilty to two counts of murder and one count of aggravated robbery. The court considered the gravity of the offences, including the brutal killing of two individuals and the theft and destruction of property. The court also took into account mitigating factors: the accused did not waste judicial time, is a first offender, a young father, and the breadwinner of his family. Balancing these factors, the court sentenced the accused to 20 years imprisonment on each count, to run concurrently, with credit for two years spent on remand. The remaining sentence to be served is 18 years. The right of appeal was explained to the accused.
