Medical evidence and the victim's testimony established the age and occurrence of sexual intercourse. The identification of the accused was direct and reliable, as the incident occurred in broad daylight and the accused was well known to the victim and witnesses. The defence of total denial was rejected due to overwhelming evidence. The court found the accused guilty of defilement and, considering aggravating and mitigating factors, sentenced him to eight years imprisonment, taking into account time already spent in custody.
