Criminal Sessions Case / Ruling on No Case to Answer

  1. 1 Whether the prosecution has established a prima facie case against the accused persons for murder and aggravated robbery.
  2. 2 Whether there is sufficient evidence implicating the accused in the commission of the offences charged.
  3. 3 Whether hearsay and suspicion can satisfy the evidentiary threshold for putting the accused on their defence.

Ratio Decidendi

The prosecution failed to adduce credible evidence implicating any of the accused in the commission of the offences charged. While the deaths, their unlawful nature, malice aforethought, theft, use of violence, and deadly weapons were established by post mortem and witness evidence, there was no direct or circumstantial evidence placing any accused at the scene or linking them to the offences. The only evidence against the accused was hearsay and suspicion, which is insufficient to establish a prima facie case. Accordingly, the court found that no case had been made out requiring the accused to be put to their defence and acquitted all accused persons on all counts.
