The accused followed the victim into the house, grabbed her removed her pant s, threw her down and had sexual intercourse with her. He stated on oath that he was being framed up because of a grudge between the father of the victim and himself. }{ \cf19\insrsid12868701 \par \par }{\cf19\insrsid6963777\charrsid12868701 Once an accused person pleads not guilty to the offence he}{\cf20\insrsid6963777\charrsid12868701 /}{\cf19\insrsid6963777\charrsid12868701 she is charged with such person thereby puts in issue each and every essential ingredient of that offence. The burden of proof in Criminal case as a general rule is on }{\cf21\insrsid6963777\charrsid12868701 prosecution to prove the guilt of the accused. The complainant PW2 Wali ko Moska testified on 16/03}{\cf24\insrsid6963777\charrsid12868701 /}{\cf23\insrsid6963777\charrsid12868701 2005 stated that she was aged 13 years meaning she was about ten years old at the time of the offence in 2002. PW3 Dr}{ \cf1\insrsid6963777\charrsid12868701 . }{\cf23\insrsid6963777\charrsid12868701 Olaro Charles testified that he examined the complainant Waliko Moska on the 2}{\cf23\super\insrsid6963777\charrsid12868701 nd}{\cf23\insrsid6963777\charrsid12868701 January 2001 at the request of the police following allegations that she had been defiled. PW3 Dr}{\cf1\insrsid6963777\charrsid12868701 . }{\cf27\insrsid6963777\charrsid12868701 Olaro also compiled his report whi}{ \cf26\insrsid6963777\charrsid12868701 ch was t}{\cf27\insrsid6963777\charrsid12868701 endered as a prosecution exhibit and marked P }{\cf28\insrsid6963777\charrsid12868701 .}{\cf27\insrsid6963777\charrsid12868701 1. The evidence and t}{ \cf26\insrsid6963777\charrsid12868701 he find}{\cf27\insrsid6963777\charrsid12868701 ings of Dr}{\cf1\insrsid6963777\charrsid12868701 . }{\cf27\insrsid6963777\charrsid12868701 Olaro Charles which were not in any way disputed tend }{ \cf26\insrsid6963777\charrsid12868701 to corro}{\cf27\insrsid6963777\charrsid12868701 borate the evidence of the complainant that someone had unlawf}{\cf26\insrsid6963777\charrsid12868701 ul sexu}{\cf27\insrsid6963777\charrsid12868701 al intercourse with her. On the basis of the evidence of PW2 Wali}{\cf26\insrsid6963777\charrsid12868701 ko Mos}{\cf27\insrsid6963777\charrsid12868701 ka and PW3 Dr, Olaro Charles I find that the prosecution has proved t}{ \cf26\insrsid6963777\charrsid12868701 he fact }{\cf27\insrsid6963777\charrsid12868701 of unlawful sexual intercourse with the complainant beyond reasonab}{\cf26\insrsid6963777\charrsid12868701 le doubt}{\cf1\insrsid6963777\charrsid12868701 . \par }\pard \s15\qj \li24\ri0\sl360\slmult1\nowidctlpar\faauto\rin0\lin24\itap0\pararsid12868701 {\cf18\insrsid285191 \par }\pard \s15\qj \li24\ri0\sl360\slmult1\nowidctlpar\faauto\rin0\lin24\itap0\pararsid285191 {\cf18\insrsid6963777\charrsid12868701 This now takes me to the third ingredient of the offence of defilement whic}{\cf29\insrsid6963777\charrsid12868701 h }{ \cf30\insrsid6963777\charrsid12868701 i}{\cf18\insrsid6963777\charrsid12868701 s to determine if the accused participated in this offence}{\cf31\insrsid6963777\charrsid12868701 . }{\cf18\insrsid6963777\charrsid12868701 The first piece }{ \cf29\insrsid6963777\charrsid12868701 of evi}{\cf18\insrsid6963777\charrsid12868701 dence that tends to implicate the accused in the commission of t}{\cf29\insrsid6963777\charrsid12868701 his off}{\cf18\insrsid6963777\charrsid12868701 enc e is the testimony of the complainant PW2 Waliko Moska}{\cf31\insrsid6963777\charrsid12868701 . }{\cf18\insrsid6963777\charrsid12868701 She ga}{\cf29\insrsid6963777\charrsid12868701 ve evi}{\cf18\insrsid6963777\charrsid12868701 dence that that fateful night she entered into the house of the accused }{\cf29\insrsid6963777\charrsid12868701 to all }{\cf18\insrsid6963777\charrsid12868701 drinking water for her friends. After having given water to her frien}{ \cf29\insrsid6963777\charrsid12868701 ds}{\cf30\insrsid6963777\charrsid12868701 , }{\cf29\insrsid6963777\charrsid12868701 she }{\cf18\insrsid6963777\charrsid12868701 went back into the house to retu}{\cf29\insrsid6963777\charrsid12868701 r}{ \cf18\insrsid6963777\charrsid12868701 n the cup. On entering the house t}{\cf29\insrsid6963777\charrsid12868701 his sec}{\cf18\insrsid6963777\charrsid12868701 ond time, the accused grabbed her and had sexual intercourse with h}{ \cf29\insrsid6963777\charrsid12868701 er}{\cf30\insrsid6963777\charrsid12868701 . }{\cf29\insrsid6963777\charrsid12868701 She }{\cf18\insrsid6963777\charrsid12868701 raised an alarm and this alarm was answered by among others h}{ \cf29\insrsid6963777\charrsid12868701 er fath}{\cf18\insrsid6963777\charrsid12868701 er}{\cf1\insrsid6963777\charrsid12868701 . }{\cf18\insrsid6963777\charrsid12868701 PWI Kazimiro Lamberto who then arrested the accused and took h}{ \cf29\insrsid6963777\charrsid12868701 im to t}{\cf18\insrsid285191 he LCs}{\cf18\insrsid6963777\charrsid12868701 . }{\cf18\insrsid285191 \par \par }{\cf29\insrsid6963777\charrsid12868701 PW}{\cf18\insrsid6963777\charrsid12868701 I Kazimiro Lamberto's evidence in this regard is that that fateful night }{\cf29\insrsid6963777\charrsid12868701 he hear}{\cf18\insrsid6963777\charrsid12868701 d his daughter Waliko Moska making an alarm to the effect that t}{\cf29\insrsid6963777\charrsid12868701 he acc}{\cf18\insrsid6963777\charrsid12868701 used was attempting to have sexual intercourse with her}{\cf1\insrsid6963777\charrsid12868701 . }{ \cf18\insrsid6963777\charrsid12868701 He answer}{\cf29\insrsid6963777\charrsid12868701 ed the }{\cf18\insrsid6963777\charrsid12868701 alarm and at the scene in the house of the accused he found t}{\cf29\insrsid6963777\charrsid12868701 he com}{ \cf18\insrsid6963777\charrsid12868701 plainant seated on the bed naked with her pants tom. On hearing this he took the complainant to h er father PW}{\cf33\insrsid6963777\charrsid12868701 I K}{\cf32\insrsid6963777\charrsid12868701 azimiro Lamberto who instead started assaulting him. \par }\pard \s15\qj \li14\ri27\sl360\slmult1\nowidctlpar\faauto\rin27\lin14\itap0\pararsid285191 {\cf33\insrsid6963777\charrsid12868701 T}{\cf32\insrsid6963777\charrsid12868701 he version of the accused sound incredible. If what he stated was true h}{ \cf33\insrsid6963777\charrsid12868701 e wo}{\cf32\insrsid6963777\charrsid12868701 uld no doubt have caused the two prosecution witnesses to be cro}{\cf33\insrsid6963777\charrsid12868701 ss exa}{\cf32\insrsid6963777\charrsid12868701 mined when they testified that PWI Kazimiro Lamberto came to t}{\cf33\insrsid6963777\charrsid12868701 he sce}{\cf32\insrsid6963777\charrsid12868701 ne }{\cf34\insrsid6963777\charrsid12868701 i}{\cf32\insrsid6963777\charrsid12868701 n answer to the alarm made by the complainant and found both t}{\cf33\insrsid6963777\charrsid12868701 he com}{\cf32\insrsid6963777\charrsid12868701 plainant and the accused at the scene which was the house of t}{\cf33\insrsid6963777\charrsid12868701 he acc}{\cf32\insrsid6963777\charrsid12868701 used}{\cf34\insrsid6963777\charrsid12868701 . }{\cf32\insrsid6963777\charrsid12868701 Not having challenged PWI Kazimiro Lamberto and PW2 Wali}{\cf33\insrsid6963777\charrsid12868701 ko Mo}{ \cf32\insrsid6963777\charrsid12868701 ska on their testimony, the only inference to draw here is that th}{\cf33\insrsid6963777\charrsid12868701 eir vers}{\cf32\insrsid6963777\charrsid12868701 ion of the incident is the correct one. I accordingly find that it is t}{\cf33\insrsid6963777\charrsid12868701 he accu}{\cf32\insrsid6963777\charrsid12868701 sed who had unlawful sexual in}{\cf33\insrsid6963777\charrsid12868701 t}{ \cf32\insrsid6963777\charrsid12868701 ercourse with the complainant in h}{\cf33\insrsid6963777\charrsid12868701 is hou}{\cf32\insrsid6963777\charrsid12868701 se, the complainant made an alarm and when PWI Kazimiro Lamber}{ \cf33\insrsid6963777\charrsid12868701 to ans}{\cf32\insrsid6963777\charrsid12868701 wered the alarm he found the two in compromising circumstances. }{\cf32\insrsid285191 \par }{\cf33\insrsid285191 \par }{\cf33\insrsid6963777\charrsid12868701 The }{\cf32\insrsid6963777\charrsid12868701 accused IS also implicated by circumstantial evidence}{\cf34\insrsid6963777\charrsid12868701 . }{\cf32\insrsid6963777\charrsid12868701 T}{ \cf33\insrsid6963777\charrsid12868701 he circ}{\cf32\insrsid6963777\charrsid12868701 umstances relied on by the prosecution are that the complainant made a}{\cf33\insrsid6963777\charrsid12868701 n alar}{\cf32\insrsid6963777\charrsid12868701 m to the eff ect that she was being sexually assaulted by the accuse}{\cf33\insrsid6963777\charrsid12868701 d }{\cf35\insrsid6963777\charrsid12868701 PWI Kazimiro Lamberto answered the alarm and on reaching the scene he found the complainant and the accused in the same house. The complainant was naked and her pants were torn. When she was taken for Medical examination, PW3 Dr}{ \cf1\insrsid6963777\charrsid12868701 . }{\cf35\insrsid6963777\charrsid12868701 Olaro Charles found her to have been defiled less than 24 hours before the said examination. The irresistible inference to make from this set of facts is that it was the accused and no one else who defiled the complainant}{ \cf1\insrsid6963777\charrsid12868701 . }{\cf35\insrsid6963777\charrsid12868701 It is now trite that if a girl or woman found in the same house with a man complains that the man had unlawful sexual intercourse with her and it is found that indeed some body had sexual intercourse with her the only influence to make is that it was that m an with whom she was in the house responsible }{\b\ul\cf35\insrsid6963777\charrsid12868701 See Ugandan vs Bikikya Zakaria Cr. Sess Case No. 294/94 (unreported) and Uganda vs Muhyanuzi Fred Crim Session Case No. 119/94. \par }\pard \s15\qj \li0\ri8\sb340\sl360\slmult1\nowidctlpar\faauto\rin8\lin0\itap0\pararsid12868701 {\cf35\insrsid6963777\charrsid12868701 Mr. Oyarmoi learned counsel for the accused attempted to discredit the testimony o f PWI Kazimiro Lamberto on grounds that the pants of the complainant he stated were torn were not exhibited and because his oral evidence did not tally with his police statement}{\cf1\insrsid6963777\charrsid12868701 . }{ \cf35\insrsid6963777\charrsid12868701 With regard to the failure of the prosecution to tender the torn pants, it is not absolutely necessary to produce exhibits before evidence is assigned evidential value}{\cf36\insrsid6963777\charrsid12868701 . }{ \cf35\insrsid6963777\charrsid12868701 Evidence not supported by exhibits, though mentioned may be cogent enough of PWI \par }\pard \s15\qj \li10\ri0\sl360\slmult1\nowidctlpar\faauto\rin0\lin10\itap0\pararsid285191 {\cf32\insrsid6963777\charrsid12868701 Kazimiro }{\cf32\insrsid16585634\charrsid12868701 Lamberto}{\cf37\insrsid16585634\charrsid12868701 \rquote s}{ \cf32\insrsid6963777\charrsid12868701 evidence is in no way reduced by failure to exhibit th}{\cf38\insrsid6963777\charrsid12868701 e to}{\cf32\insrsid6963777\charrsid12868701 m pants.
