The evidence established that the death resulted from a fight between the accused and the deceased, arising from a domestic dispute, without evidence of a premeditated plan to kill. The defence of self-defence was not fully available, but the circumstances did not support an inference of malice aforethought. Consequently, the accused was acquitted of murder but convicted of manslaughter, a minor and cognate offence, as the facts proved satisfied its ingredients under sections 187 and 190 of the Penal Code Act.
