Ratio Decidendi

The court found that while the death of Nakigozi Faridah was established, the medical evidence was inconclusive as to whether the death was caused unlawfully by the accused. The prosecution failed to establish a clear and proximate chain of causation linking any unlawful act or omission by the accused to the death. Without proof beyond reasonable doubt that the death was unlawfully caused, an essential ingredient of the offence of murder was not met. Consequently, the accused could not be held criminally liable for murder under sections 188 and 189 of the Penal Code Act, and was acquitted.
