Procedural Posture

Criminal Law / Judgment

  1. 1 Whether the death of Bright Adolf occurred and was caused by an unlawful act.
  2. 2 Whether malice aforethought was present in the cause of death.
  3. 3 Whether the accused persons participated in causing the unlawful death of the deceased.

Ratio Decidendi

The prosecution proved the death of Bright Adolf, its unlawful cause, and malice aforethought beyond reasonable doubt. However, the evidence failed to directly and credibly place the accused persons at the scene as perpetrators of the act that caused death. The dying declaration was not satisfactorily corroborated, and none of the witnesses saw the accused light the fire that led to the deceased's death. The prosecution did not prove the participation of the accused persons to the required standard. Consequently, not all essential ingredients of murder were proved beyond reasonable doubt, and the accused persons are acquitted.
