Procedural Posture

Criminal Trial / Ruling on Submission of No Case to Answer

  1. 1 Whether the prosecution has established a prima facie case against the accused sufficient to require him to answer the charge.
  2. 2 Whether the accused was properly identified as a participant in the alleged aggravated robbery.
  3. 3 Whether the ingredients of aggravated robbery have been proved by the prosecution evidence.

Ratio Decidendi

The prosecution failed to adduce sufficient evidence to establish a prima facie case against the accused. Neither witness directly identified the accused as a perpetrator of the alleged aggravated robbery, and the evidence presented did not prove any of the essential ingredients of the offence. The court found that the nature of the evidence fell short of the standard required for a reasonable tribunal to convict in the absence of a defence. Accordingly, the accused was acquitted under Section 74(1) of the Trial on Indictments Act.
