The Court of Appeal held that its appellate jurisdiction is strictly statutory and that there is no inherent right of appeal from all decisions of the High Court. Article 134(2) of the Constitution and section 10 of the Judicature Act provide that an appeal lies to the Court of Appeal only from decisions of the High Court as prescribed by law. Section 45(7) of the Criminal Procedure Code Act deems High Court revision proceedings to be an appeal only where there has been a conviction or acquittal, and section 204 of the Magistrates Courts Act limits the right of appeal to such circumstances.
