Procedural Posture

Criminal Session / Judgment and Sentencing

  1. 1 Whether the accused persons unlawfully caused the death of Pampus Okorio.
  2. 2 Whether the accused persons acted with malice aforethought.
  3. 3 Whether the evidence supports a conviction for murder or a lesser offence of manslaughter.

Ratio Decidendi

The court found that while the accused persons, acting as local leaders, assaulted the deceased with significant force, resulting in his death, the prosecution failed to prove malice aforethought or a common intention to kill beyond reasonable doubt. The evidence established that the accused unlawfully caused the death of Pampus Okorio, but the absence of exhibited weapons and lack of proof of intent to kill precluded a conviction for murder. The accused were therefore acquitted of murder and convicted of manslaughter under sections 182 and 185 of the Penal Code Act. The court emphasized the abuse of office by the accused and imposed a deterrent sentence to address the misuse of authority.
