Procedural Posture

Criminal Appeal / Judgment on Appeal

  1. 1 Whether the memorandum of appeal filed by the appellant met the statutory requirements under section 28(4) of the Criminal Procedure Code.
  2. 2 Whether the trial magistrate erred in law and fact by failing to properly evaluate the prosecution evidence against the respondents.
  3. 3 Whether the appeal should be dismissed for procedural irregularities.

Ratio Decidendi

The court found that the memorandum of appeal filed by the appellant was procedurally defective as it failed to particularise the matters of law and fact in which the lower court was alleged to have erred, contrary to section 28(4) of the Criminal Procedure Code. The memorandum was filed late, in a stereotyped and blanket form, and did not meet the legal requirements for an appeal. The court also criticised the appellant's conduct in seeking adjournment by letter and unilaterally filing written submissions without court approval. Given these procedural irregularities and the lack of substantive grounds in the memorandum of appeal, the court dismissed the appeal.

Court Disposition

appeal dismissed

Orders

  • The appeal is dismissed.
  • No convictions or sentences are substituted for the acquittals.
