Ratio Decidendi

The court found that the accused unlawfully caused the death of the deceased by striking him on the head with a panga, based on credible eyewitness testimony and corroborative evidence. However, there was a slight possibility of provocation arising from vulgar insults allegedly uttered by the deceased, which, although not fully substantiated, created sufficient doubt regarding malice aforethought. The court held that in view of this provocation, it was unsafe to convict the accused of murder. Instead, the accused was found guilty of manslaughter under Section 182 of the Penal Code Act, as the evidence supported unlawful killing without the requisite malice aforethought for murder.
