Procedural Posture

Criminal Case / Sentencing After Plea Bargain

  1. 1 Whether the plea of guilty was entered voluntarily, knowingly, and intelligently by the accused.
  2. 2 What is the appropriate sentence for the offence of aggravated defilement in light of the plea agreement, sentencing guidelines, and comparable case law.
  3. 3 Whether the period spent on remand should be deducted from the sentence imposed.

Ratio Decidendi

The court found that the accused's plea of guilty was entered voluntarily, knowingly, and intelligently, and that the factual basis for the plea was established. In determining the appropriate sentence, the court considered the sentencing guidelines, the mitigating factors (including the accused's guilty plea and first offender status), and comparable sentences in similar cases. The court accepted the plea agreement's proposed sentence as appropriate, subject to the mandatory deduction of the period spent on remand. Accordingly, the court sentenced the accused to seven years and three months' imprisonment, after deducting nine months spent on remand, in accordance with the law.
