The court held that although the Criminal Procedure Code Act is silent on reinstatement of appeals dismissed for want of prosecution, Section 33 of the Judicature Act provides the High Court with broad discretionary powers to do justice in deserving cases. The applicant demonstrated sufficient cause for the delay, namely the need to consult the Director of Public Prosecutions and the complexity of the record. The applicant also acted promptly in seeking reinstatement. The respondents did not object. The court found that the interests of justice required the appeal to be heard on its merits and exercised its discretion to reinstate the appeal.
