The court found that while the death of Kasamba Charles was proved and was caused unlawfully with malice aforethought, the evidence linking the accused, particularly Wanican Julius, to the crime was insufficient. The identification evidence was unreliable due to poor visibility, lack of familiarity, and the circumstances under which the alleged recognition occurred. The circumstantial evidence only established that Wanican Julius was one of the last persons seen with the deceased, but did not exclude other reasonable possibilities as to how and by whom the deceased met his death.
