Ratio Decidendi

The Appellate Division found that both parties and the Trial Court failed to ensure that the Reference was supported by admissible evidence, specifically affidavit evidence, as required by law and agreed at the scheduling conference. The absence of such evidence meant that the Trial Court proceeded to judgment on the basis of submissions and unproven annexures, which is a grave procedural irregularity. The Court held that it could not condone or perpetuate this injustice and, invoking its inherent powers, remitted the Reference back to the Trial Court for a hearing de novo, with directions for proper presentation of evidence. Each party was ordered to bear its own costs of the appeal.
