The High Court's jurisdiction to intervene in arbitration matters is strictly limited by Section 9 of the Arbitration and Conciliation Act, which prohibits court intervention except as expressly provided in the Act. Joinder of parties to arbitration proceedings is not one of the permitted interventions. Arbitration is fundamentally a contractual mechanism, and only parties who have expressly agreed to arbitrate can be joined to such proceedings. The respondent, Kampala Capital City Authority, was not a party to the sublease agreement or the arbitration clause and did not expressly or impliedly agree to arbitrate disputes arising from that agreement.
