The court found that the judgments and decree entered by the trial Registrar under Order 9 rules 6, 8 & 9 of the Civil Procedure Rules were erroneous because the underlying suit was not for a liquidated demand or pecuniary damages, but for declarations and other orders concerning land. The proper procedure should have been under Order 9 rules 10 & 11, which require the suit to proceed as if a defence had been filed or to be set down for hearing ex parte. The Applicant demonstrated sufficient cause for the delay in filing its defence, as the error was due to counsel's mistaken computation of time and not due to any lack of diligence by the Applicant.
