Ratio Decidendi

The court found that the cause of action for trespass accrued in 2019 when the defendant erected a wall on the plaintiff's land, not in 2005 as alleged by the defendant. Trespass is a continuing tort and, as such, is not subject to the limitation period for proprietary claims under section 5 of the Limitation Act. Regarding res judicata and lis pendens, the court determined that the matters in issue, parties, and courts in the previous suit differ from those in the present suit.
