Ratio Decidendi

The application for leave to appeal out of time was lodged without a notice of appeal having been filed, contrary to rule 75 of the Rules of the Court of Appeal, which mandates that a notice of appeal be lodged within fourteen days of the decision. The absence of a notice of appeal rendered the application misconceived and fatally defective. The court held that procedural requirements for commencing an appeal must be strictly adhered to, and the discretion to extend time cannot cure the absence of a foundational procedural step. The reference was allowed on this ground alone, and the application for leave to appeal out of time should have been struck out. Costs were awarded to the appellant.
