Miscellaneous Application / Ruling on Application for Review of Abatement Order

  1. 1 Whether the Applicants are entitled to a review of the impugned order.
  2. 2 Whether the Applicants are entitled to the reliefs sought.

Ratio Decidendi

The court found that the Applicants failed to demonstrate any new and important evidence, mistake, or error apparent on the face of the record to justify review of the abatement order. The court held that the trial judge had already taken judicial notice of the Covid-19 lockdown and its impact, and the date of lifting the travel ban was widely known and considered. The letter requesting a hearing date was already on record and considered by the trial judge, thus not constituting new evidence. The Applicants' arguments amounted to a re-evaluation of evidence, which is not permissible in a review application. Consequently, the application for review was dismissed for lack of merit.
