Ratio Decidendi

The defendant, having elected to purchase the reversionary interest from the plaintiffs' predecessor, ceased to be a lessee and became a purchaser. Upon execution of the sale agreement and part payment, the lease agreement lapsed and the relationship became that of vendor and purchaser. The defendant breached the contract by failing to pay the balance of the purchase price, and thus occupies the suit land without any legal right. The doctrine of estoppel by election precludes the defendant from asserting the validity of the lease after electing to purchase the reversionary interest.
