The respondent's subsequent application for leave to appeal and for extension of time was made only after the applicant had already moved to strike out the Notice of Appeal. The Court held that the procedural rules are mandatory and that failure to comply with the time limits for instituting an appeal is fatal. As a result, the Notice of Appeal filed by the respondent was struck out with costs to the applicant.
