Ratio Decidendi

The High Court Land Division at Kampala does not have geographical jurisdiction over the suit property located in Mbale district. Although the High Court has unlimited jurisdiction in civil matters, Section 12(a) of the Civil Procedure Act requires suits for recovery of immovable property to be filed in the court within the local limits of the property's location. Since the defendant disputed geographical jurisdiction and the property is in Mbale, the suit cannot be tried at Kampala. Rather than dismissing the suit, the court orders its transfer to the High Court at Mbale, which possesses both geographical and pecuniary jurisdiction. Each party is to bear its own costs.
