Neither Samanya Joshua nor the clan had authority to sell or distribute the land without a grant of letters of administration. The purported sale to Namulondo Monica was therefore void, and she could not be deemed to have acquired legal or constructive possession. The trial Magistrate erred in law by holding otherwise and in awarding general damages for trespass, as the respondent was not in lawful possession.
