The Court determined that the Reference was filed well beyond the two-month limitation period required by Article 30(2) of the Treaty for the Establishment of the East African Community. The cause of action, being the Respondent’s refusal to pay the claimed debt, was manifestly known to the Applicant at the time he first approached the domestic courts of Rwanda for relief, and certainly by the time the Respondent appealed the Commercial Court’s decision. The Applicant’s reliance on the Ombudsman’s letter as the starting point for limitation was rejected, as the letter merely culminated the process and did not constitute a new actionable violation.
