Procedural Posture

Civil Suit / Ruling on Preliminary Objection

  1. 1 Whether the Plaintiff has locus standi to sue in Civil Suit No. 271 of 2018.
  2. 2 Whether Civil Suit No. 271 of 2018 discloses a cause of action.

Ratio Decidendi

The Plaintiff, having purchased a leasehold interest that was never registered, did not acquire a legal interest in the suit land enforceable against third parties such as the Defendants. The Defendants had no notice of the Plaintiff's interest and were not parties to the transaction. The Plaintiff's rights, if any, are enforceable only against the vendors from whom it purchased the land, not against the Defendants who acted lawfully in cancelling the title. The Plaintiff lacks locus standi and the suit discloses no cause of action against the Defendants. The suit is therefore dismissed with costs to the Defendants.
