Miscellaneous Application / Application to Set Aside Dismissal and Reinstate Prior Application

  1. 1 Whether the applicant established sufficient cause for absence when Civil Application No. 388 of 2017 was dismissed.
  2. 2 Whether the application should be reinstated on the Court Register and determined on its merits.
  3. 3 Whether there was proper service of process on the respondents as required by the rules.

Ratio Decidendi

The applicant failed to establish sufficient cause for absence when Civil Application No. 388 of 2017 was dismissed. The only affidavit in support was from counsel Amar Ali, with no affidavit from the applicant or from Siraj Ali, and the explanations provided were contradictory and unsupported by evidence. The applicant did not contest the respondent's assertion that there was no service of process, violating Rule 50(5). The Court found negligence, inaction, and lack of bona fide on the part of the applicant and counsel. Accordingly, the application to set aside the dismissal and reinstate Civil Application No. 388 of 2017 was dismissed.
