The Court of Appeal held that section 96(1) of the Parliamentary Election (Interim Provisions) Statute No. 4 of 1996 only provides for appeals against final determinations of election petitions by the High Court, not against interlocutory orders. The order appealed from, which vacated a stay of proceedings, was interlocutory in nature as it did not finally determine the petition.
