Meydan Group LLC v Banyan Tree Corporate Pte Ltd [2014] DIFC CA 005 (03 November 2014)
The DIFC Courts have jurisdiction to recognise and enforce a domestic arbitration award made in Dubai but outside the DIFC, without requiring the presence of assets or personal jurisdiction in the DIFC. The grounds for refusing recognition are exhaustively set out in Article 44 of the DIFC Arbitration Law. Forum non conveniens does not apply as there is no alternative forum for recognition within the DIFC, and use of the DIFC Courts as a conduit for enforcement in Dubai is not an abuse of process.
