Procedural Posture

Employment Appeal / Court of Appeal Judgment

  1. 1 Whether the dismissal of the Appellant was discriminatory on grounds of marital status under Article 56 of the unamended DIFC Employment Law
  2. 2 Whether the Appellant was entitled to investigative hearings or disciplinary procedures prior to dismissal
  3. 3 Whether the Appellant was entitled to end of service gratuity under the relevant laws

Ratio Decidendi

The Appellant's dismissal was not discriminatory under Article 56 of the unamended DIFC Employment Law because it was based on the implementation of a bona fide occupational requirement (the EPR Policy) to avoid conflicts of interest, not on marital status. The unamended Employment Law does not provide for unfair dismissal claims or implied terms beyond the contract. The Appellant was not entitled to end of service gratuity as he was enrolled in the UAE Federal Pension Scheme. No evidence supported the defamation claim.
