Ratio Decidendi

Disclosure of documents by EYME pursuant to an ADGM Court order is permitted under the exceptions in Article 18 of the 2023 Auditors Law, as the ADGM Court qualifies as a 'judicial authority' under UAE law. The repeal of the 2014 Auditors Law and its replacement by the 2023 Auditors Law means undertakings given under the former are subject to the exceptions in the latter. Production of documents does not contravene the Penal Code or Commercial Companies Law when made under court order. EYME may redact information prohibited from disclosure under the Data Protection Law, but is otherwise required to produce the documents withheld under the February Order.
