Ratio Decidendi

The Employment Tribunal erred in its approach to the comparator analysis by treating age-related differences as material, misapplied the test for less favourable treatment by focusing on the employer's motivation rather than the effect of age, and failed to apply the correct 'but for' causation test. The only permissible conclusion was that the claimant was treated less favourably because of age, establishing a prima facie case of direct age discrimination subject to justification.
