The BVI court does not have power under the current rules to authorise service out of the jurisdiction of a claim form seeking only a freezing injunction; however, where the court has personal jurisdiction over a party, it has power to grant a freezing injunction to assist enforcement of a prospective or existing foreign judgment, and the practice of granting such injunctions is not limited to cases where substantive proceedings are brought in the BVI.
