The claimant failed to demonstrate ongoing emotional dependency between herself and her father since his departure to the UK in 2012. While there was evidence of regular financial support, the evidence did not establish the required element of continuing emotional dependency necessary to engage Article 8 ECHR family life. The First-tier Tribunal erred in law by not adequately addressing the gap in evidence and the requirements set out in Kugathas and subsequent case law. Accordingly, Article 8 was not engaged and the appeal must be dismissed.
