Procedural Posture

Employment Appeal / Appeal From Employment Tribunal Judgment Entered 25 September 2008

  1. 1 Whether the Employment Tribunal erred in dismissing the claim of race discrimination
  2. 2 Whether the Employment Tribunal erred in finding unfair dismissal
  3. 3 Whether the Tribunal failed to make necessary findings of fact regarding alleged racist remarks

Ratio Decidendi

The Tribunal did not err in law in dismissing the race discrimination claim as no actual or hypothetical comparator was identified and there was no direct evidence that race was a causative factor in the dismissal. The finding of unfair dismissal was upheld as the final written warning and subsequent dismissal were unreasonable, but this did not equate to race discrimination. The Tribunal did not substitute its own view for that of the employer.

Court Disposition

Appeal and cross-appeal dismissed

Orders

  • Mr Dhillon's appeal against dismissal of race discrimination and victimisation claims is dismissed.
  • May & Baker Ltd's cross-appeal against the finding of unfair dismissal is dismissed.
