The making of false and unreasonable disciplinary accusations by the employer was capable of constituting a detriment under s.4(2)(c) of the Race Relations Act 1976, even if no formal disciplinary sanction was imposed. The Tribunal erred in law by holding otherwise. However, the summary dismissal for disobedience of a reasonable instruction was lawful and did not constitute wrongful dismissal.
