Waiver of legal professional privilege requires more than mere reference to legal advice; there must be sufficient disclosure of the substance of the advice and reliance or deployment of that advice to gain an advantage in litigation. In this case, the references to legal advice did not amount to waiver as there was no reliance on the advice in the proceedings. Redaction of privileged material from disclosed documents is permissible unless the privileged content is relied upon at trial.
