Ratio Decidendi

The 2nd Respondent did not acquire good title to the property as the person who sold to them had no legal title to pass; the transaction was void ab initio due to fraud. The lower court erred in finding otherwise. The Appellant and 1st Respondent had a valid contract for sale, evidenced by offer, acceptance, and part payment. The certificate of title issued to the 2nd Respondent and any subsequent buyer is cancelled, and the property reverts to the estate of the deceased to be administered by the Administrator General.
