Ratio Decidendi

The contract of sale between the 1st and 2nd Defendants was executed freely and voluntarily, but the 1st Defendant failed to conduct due diligence regarding the interests of other beneficiaries occupying the property. This failure precluded the 1st Defendant from being a bona fide purchaser for value without notice. Accordingly, the certificate of title issued to the 1st Defendant is cancelled.
