The Plaintiffs and Defendants remained distinct legal entities at the material time, and the Defendants, including their advocates, failed to exercise due diligence. The judgment debt had not been satisfied at the time of execution, so no malice or abuse of process was found, but liability for trespass and wrongful execution was established.
