Procedural Posture

Civil Appeal / Supreme Court Judgment

  1. 1 Whether the present suit is barred by res judicata due to a prior judgment involving the same parties
  2. 2 Whether the claims are statute barred under the Limitation Act, 1939
  3. 3 Whether claims by deceased plaintiffs can proceed via substitution

Ratio Decidendi

The Supreme Court held that the present claims were not barred by res judicata as the reliefs sought were distinct from those in the earlier Goodson Tembo case; the current claims related to accrued benefits and not redundancy. The court further held that the claims were not statute barred as the appellant held the funds as a constructive trustee, bringing the case within section 19(1)(b) of the Limitation Act, 1939. Substitution of deceased plaintiffs with their personal representatives was proper. The appeal was dismissed and the matter was ordered to proceed to trial.
