Ratio Decidendi

The Court of Appeal held that the High Court properly exercised its discretion in granting the interim injunction to preserve the only assets in Zambia pending determination of the redundancy claims, as damages would not be adequate if assets were removed. The court also held that Ms. Turner-Barnes, as Chief Human Resources and Administration Officer who authored the termination letters, was properly joined as representative of the appellant, and that the Attorney General was properly joined due to the Ministry of Labour's oversight role. The appellant was found to have been heard on the issues of capacity and amendment of pleadings.
